Body and Mind K9 Terms and Conditions

SERVICE AREA

Body and Mind K9 services are currently offered in Long Beach, California. Clients living in surrounding coastal areas (San Pedro, Seal Beach, Sunset Beach, Huntington Beach) and Los Angeles area must inquire about availability via email or contact form prior to booking.

BOOKING AND RESCHEDULING POLICY

BAMK9 requires a minimum of 24-hour cancellation notice for Client to qualify for rescheduling. Any cancellations less than 24 hours before the scheduled session will be charged the full session amount as a cancellation fee, and a new booking and payment will be required to book a future session.

Memberships: All new memberships are subject to a 3-month commitment. Canceling prior to the end of the initial 3-month commitment period will be subject to a penalty equal to 1 (one) month of membership rate. The Client may cancel at any time after the 3-month commitment is fulfilled.

Packages: Package Plans are valid for 3 months from purchase date. No roll-over sessions apply.

There will be no penalty if the Client cancels or reschedules 24 hours or more before their session. If the Client does not cancel or reschedule a session prior to 24 hours, one session will be deducted from the Client’s Package.

Packages must be paid for in full at the time of purchase.

Packages are non-refundable.

BAM WALKS REQUIREMENTS

The Client must have the Dogs gear (6-foot leash, ID collar, water container and one of the following: front clip harness, martingale, prong collar) ready and in view for the Walker to quickly utilize.
The Client understands that BAMK9 Walkers do not use head halters, back clip harnesses, or flat collars for walking.
The Client agrees to have a flat collar with updated ID tags on their Dog.
The Client ensures that the Dog can walk calmly on a leash with minimal issue, and if the Walker finds otherwise, Coaching or Doggo-Only sessions will be required to continue walks.

BAM WALKS NO GUARANTEE OF RESULTS

The Client recognizes that while BAMK9 will work with their dog on basic commands and leash etiquette during walks, it is NOT a training session; therefore, no training or results will be guaranteed. The Client further understands that the recommendation of any other product or service by Body and Mind K9, LLC does not guarantee satisfaction with that product or service.

ACKNOWLEDGEMENT

By booking this service, the Client acknowledges, agrees, and understands that BAMK9 has not represented, promised, guaranteed, or warranted that the Client’s Dog can be trained, that the Client’s Dog will never bite, that the Client’s Dog will not be dangerous or vicious in the future, that the Client’s Dog will not exhibit other behavioral problems or that the training will last for any particular amount of time as each dog is different in regards to ability, breeding and temperament. The Client acknowledges and agrees that there is no guarantee that their dog will achieve the desired level of training despite the best efforts of Body and Mind K9, LLC. The Client further understands that the recommendation of any other product or service by Body and Mind K9, LLC does not guarantee satisfaction with that product or service.

ASSUMPTION OF RISK

The Client understands that inherent risks are associated with training, socializing, walking, and working with dogs in general. The Client assumes any and all responsibility for themselves and their dog during training, walking, and any other work with BAMK9 and all affiliated parties, assuming due diligence and care have been exercised. The Client will not hold BAMK9, any affiliates, or property owners responsible for any injuries or misfortunes (to/by the Client or to/by the Dog) while training, walking, or any other work, should they occur. The Client further understands that due to how dogs interact with one another, cuts or scratches can occur to the Client or their dog, even though the dogs are carefully supervised. The Client also understands that their participation in any of these activities is not without risks, such as tripping, falling, getting knocked down, jumped on, bitten, scratched, etc.

RELEASE OF LIABILITY

The Client hereby releases and agrees to save and hold harmless BAMK9 and any affiliates or property owners from any and all liability, claims, suits, actions, loss, injury, or damage of any nature or kind, or for any liability, claims, suits, actions, loss, injury or damage which the Client or the Dog may sustain or which may be caused in any way by the Dog. Without limitation, the Client agrees to fully indemnify BAMK9 and any affiliates or property owners for any and all such liability, claims, suits, actions, losses, injury, or damage. The Client understands they are solely financially responsible for any damage or harm caused by the Dog during training, socializing, or walking.

The Client takes it upon themselves to ask questions and use their best judgment. The Client understands that they do not have to do anything or allow anything they do not feel comfortable with. The Client understands that in enrolling their Dog into any of BAMK9's programs, BAMK9 relies upon the Client’s representation that their dog is in good health and has received the necessary vaccinations (or equivalent alternatives) as agreed upon by the Client’s veterinarian.

INDEMNIFICATION

Client agrees that they are and will be responsible for their conduct and the conduct of their dog and others accompanying them (including minor children) at all times. The Client agrees to indemnify and hold harmless BAMK9, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers, and other representatives (“Body and Mind K9, LLC Personnel”) from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of the Client, their dog, and any other persons accompanying them, including any minor children, during the course of training or related activities, as well as by the conduct of their dog under their own care as a result of following training instructions. This provision applies whether the claims are made by the Client, members of their family, their accompanying guests, Body and Mind K9, LLC Personnel, or third parties.

PHOTO AND SOCIAL MEDIA RELEASE

By booking a service, the Client gives BAMK9 permission to publish the likeness or image of the Client and/or their Dog in print, electronic, or video format. The Client releases all claims against BAMK9 with respect to privacy rights, publicity rights, copyright ownership, and publication, including any claim for compensation related to the use of the materials.

SAVINGS CLAUSE

The Client expressly agrees that the foregoing assumption of risk, release, waiver, and indemnity provisions are intended to be as broad and inclusive as permitted by applicable law, and that if any portion thereof is held invalid, The Client agrees that the remaining provisions will continue in full force and effect.

KNOWING AND VOLUNTARY EXECUTION

By attending class, private sessions, or sending their dog on a walk with BAMK9 or its members, the Client declares they are at least 18 years of age and can consent to this Agreement. The Client acknowledges that they have carefully read this Agreement, understand its contents, and agree to be bound by its terms. The Client specifically understands that this Agreement includes an assumption of the risk of Body and Mind K9, LLC’s negligence and a release of Body and Mind K9, LLC’s liability.

SOLE AGREEMENT:

Terms and Conditions supersede all prior discussions, representations, warranties, and agreements of the parties and expresses the entire agreement between the Client and BAMK9 regarding the matters described in these Terms and Conditions. Client agrees that, except for that which is specifically written in these Terms and Conditions, no promises, representations, or oral understandings have been made with regard to the Dog or anything else.

CLIENT AGREEMENT:

By booking or participating in Body and Mind Services, I have read, acknowledge, and agree to all terms, conditions, and legal provisions as set forth in the Terms and Services, representing my entire agreement with BAMK9. Furthermore, my booking of services is proof of my acceptance of said terms. I authorize Body and Mind K9 to charge my credit card as payment for services.
